By closer I mean one can’t be asked to travel 300 miles away to see his child every week. I’ve resided in my present town all my life, have a secure permanent well paid job so I can’t possibly be asked to travel for one whole day – which would leave me little if any time at all to spend with my child when I do see him. What would the court suggest, recommend in a situation like mine?

  3. Well, if she left the state without first making sure it was okay in court, she can get in trouble. You can request she be required to stay in the state to avoid a hardship on you seeing your child. Or you can request that since she is who left without the courts permission, she pay to bring the child to see you untilt he child is old enough to travel alone. This would apply also if she moved out of state.

    If she is in the same state, you can ask that she split or pay the costs of travel.

  4. It really depends on the state statues in a divorce. If I were you I would first contact legal aid or your lawyer, they are know the ins and outs of child custodial and the limitations thereof. Best wishes

If she moved after the petition for divorce was filed, she may very well have to come back if she hasn’t been there long enough to prove she’s established with a job, home, etc (which she can’t if left after); if she moved before filing, it’s not so easy to force her to come back. Where’d she go? To family? Harder to make her come back. You CAN be forced to travel to see the baby.

  6. Travel the night before, stay at a hotel and spend the entire day and part of the next day with your child. Then drive back home. Wonder why she ran so far away from you. Hmmm.

  7. It is not up to us….. it is up to your lawyer to plead with the judge.
